The products or items advertised on this site are posted by third party users and OBS accept no responsibility for the quality of the item, or the legal right of the seller to sell these items.

Use of this site constitutes your acceptance of these terms and conditions which take effect on the date you first use the site. OBS reserves the right to change these terms and conditions at any time by posting changes online. You are responsible for reviewing regularly information posted online to obtain timely notice of such changes. Any visitor to the Web site providing information to OBS agrees that OBS has unlimited rights to such information as provided and that OBS may use such information in any way we may choose. Such information as provided by the visitor shall be non-confidential. We shall never pass on or sell identifiable information relating to individuals other than information that is passed from buyer to seller during the payment gateways or processes involved in the normal function of the site.

Visitors to the site must not use the any of the systems to contact pitch-holders for any purpose other than to genuinely enquire about items for sale. The sending of unsolicited mail via this site is not acceptable.

If there is any conflict between these Terms and Conditions and rules and/or specific terms of use appearing on this site relating to specific material then the latter shall prevail.

If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and Wales.

If these Terms and Conditions are not accepted in full, the use of this site must be terminated immediately.

Specific restrictions to items listed for sale on this site.

You must be the legal owner of the items listed for sale.

Any items listed that is capable of being posted must include the cost of postage. These costs must be realistic and you must not realise any profit from the postage costs. Please refer to the cost charts on carriers or couriers websites such as Parcelforce.

Sellers are solely responsible for ensuring no copyright infringements take place. We cannot check all items and if an infringement takes place and we are approached, we shall refer the agency involved to the seller. We may remove items or entire pitches to ensure the law is not being broken.

There are certain items which you cannot sell via this web site. The following list is not exhaustive and you should observe the legal (and moral) implications when offering something for sale.

• Cars/motorcycles/Boats (parts & accessories are permitted however)
• Houses, or any property which is used as guarantee for a loan or where a legal process is involved in the sale.
• Items of an explicit sexual nature. (Pornography, Sexual paraphernalia etc)
• Tablets, pills or any other kinds of pharmacological products.
• Pirate copies of films, music or any other media covered by piracy laws. Any seller found to be selling pirate media will be reported to FACT.
• Human body Organs for transplant (kidneys etc)
• Promises of sexual activity (such as taking of virginity etc)
• Children
• Animals

You are reminded that this list is not intended to be exhaustive and OBS reserve the right to police all and any items posted for sale. If OBS deem any item inappropriate, we shall without notice remove the item from the database. In certain circumstances we may remove the entire pitch from the site. If your pitch or item is removed due to the listing of an inappropriate item , you are not entitled to any refund whatsoever. Listing items on this site means your are agreeing to the terms and conditions issued by OBS. We shall hear no appeals against the removal of inappropriate items. You care not permitted to use any scripting or other means of altering how your items display. Any use of scripting within the free text areas of any form will result in removal of item or in the case of more than one item in that pitch, the entire pitch will be be deleted. This will attract NO refund.

Use of Email Generator

You must not send unsolicited emails with this facility. The originating email is sent via our mailserver to you for forwarding to suitable recipients. We shall seek to recover any losses from individuals who cause a complaint to be made against OBS in relation to unsolicited emails or spam.

Rules of sale and purchase through OBS

Buyers are entering a contract to buy once a haggle is accepted. If you click on the buy now button and enter your username and password, or if your haggle is accepted, you MUST complete the purchase within 21 days (sellers can relist the item at any time however). If you fail to complete the purchase, the item can be relisted free of charge and we may ban the potential buyer from future visits to the site by means of removing them from the database. In the event of a genuine problem with completing a purchase, you are advised to be open and honest and enter into dialogue with the seller.

Paypal charge a commission for transfer of money. Please be aware that the amount you receive from the buyer will be MINUS the paypal fees. You may, at your discretion, add a surcharge to allow for Paypal fees. This surcharge must not exceed 2% of the cost of your item including postage costs.

OBS accepts no liability or responsibility for any non-completion of any purchase from a seller on this site. OBS will not enter into any mediation to resolve any conflict between seller and buyer. Delivery of the goods is the sellers responsibility. The saleability of the goods is the responsibility of the seller and must not misrepresent items for sale. The seller must be the legal owner of the goods being offered for sale. Sellers should not send goods until funds have cleared.

16p is the cost when buying the cheapest area 4 (£4.00) pitch and listing all 25 items. This does not apply to any other offer on the site. Pitch's over 6 months old can be removed by OBS if ALL items are unsold.

We do not offer pitches free of charge. Any user who fails to pay or starts a pitch bypassing the payment gateways shall be considered to have obtained property or services by deception. We reserve the right to prosecute anyone who acts dishonestly in the use of our site. Use of false details when registering will also be treated accordingly. We will recover all costs associated with dishonest activity.

Car boot sale listings.

Persons submitting car boot sale listings on this site will be also follow the extra terms and conditions below.
The advertiser is responsible for the accuracy of the listing submitted. We (OBS) shall not be responsible for any losses whatsoever arising from inaccuracies in car boot listings. We do not guarantee that placing a listing will increase visitor numbers to any event. We do not endorse any other parties who may be trading at the event including food vendors etc.

The listing fee is not returnable. Please enter dates very carefully as they are not editable. If an event is cancelled it is the responsibility of the person who submitted the listing to edit the listing and tick the event "cancelled box". We shall not be responsible for losses arising from cancelled events.

We shall not be responsible for losses arising from failure of the car boot sale listing system. We shall not be responsible for losses arising where the listing has failed to be displayed what ever the cause.
